Cave Rescue: Elon Musk's Lawsuit Defence

Surprisingly - at least to me - Elon Musk has not settled out of court with the cave expert Vern Unsworth. A preminiary hearing of his defamation case is now being heard in the USA. Unsworth, it will be recalled, was the first on the scene with detailed first-hand knowledge of the cave and who recommended the British divers who found the boys be flown to Thailand. After Unsworth described Musk's idea of a mini-submarine a “PR stunt” and that Musk could “stick his submarine where it hurts.” Musk publicly called him "a pedo guy". In later tweets to Buzzfeed, he called Unsworth a "child rapist".

Musk's first explanation about the libel was this.
“By referring to Mr Unsworth as ‘pedo guy,’ I did not intend to convey any facts or imply that Unsworth had engaged in acts of pedophilia,” Musk said in a court filing on Monday.

“Pedo guy was a common insult used in South Africa when I was growing up. It is synonymous with ‘creepy old man’ and is used to insult a person’s appearance and demeanor, not accuse a person of pedophila.”
But that surely does not hold much water considering he went on to admit that one of his aides was instructed to hire a private detective at a cost of more than US$50,000 to conduct an investigation of Unsworth on Musk’s behalf.
“The investigator learned that Mr Unsworth frequented Pattaya beach which is well known for prostitution and sex tourism, and that Mr Unsworth was unpopular at the rescue site because other rescue workers thought that he was ‘creepy", Musk’s lawyers said in the filing.
“The investigator reported that Mr Unsworth was a fixture in Pattaya Beach, Thailand – a locale notorious for prostitution and child trafficking, that he had a taste for young Thai girls, that he whoremongered his way through the go-go bars of Thailand, that his only friends were his ‘sexpat’ peers, and that he married his Thai wife when she was a teenager, after starting a relationship when she was a young girl,” the response from Musk’s lawyers reads.
The trial is scheduled for December 2.
